Description: Up for auction a RARE! "Alabama Judge" Robert E Lee Jr Hand Written Note.    ES-9022 Walter "Johnny D." McMillian (October 27, 1941 – September 11, 2013) was an African-American pulpwood worker from Monroeville, Alabama, who was exonerated by the Alabama Court of Criminal Appeals in Walter McMillian v. State (1993) with defense attorneys Bryan Stevenson, Michael O'Connor, and Bernard E. Harcourt. From 1990 to 1993, the Alabama Court of Criminal Appeals had turned down four appeals. On March 3, 1993 all five judges concurred on the reversal of his conviction. The Court of Criminal Appeals reversed the lower court decision and ruled that he had been wrongfully convicted. His conviction for capital murder was wrongfully obtained, based on police coercion by Sheriff Tom Tate and others and perjury by witnesses. In the 1988 trial, the judge, Robert E. Lee Key, Jr., overrode the jury's sentence using an unique and controversial Alabama practice called "Judge Override", and had imposed capital punishment. After serving six years on Alabama's death row for a crime he did not commit, the prosecutors dismissed the case for lack of evidence, dropping all charges against him.The controversial case received national attention beginning in the fall of 1992, when it was featured in the CBS News program 60 Minutes. The story was featured in a 1995 book entitled Circumstantial Evidence: Death, Life, and Justice in a Southern Town by former Washington Post journalist, Pete Earley. Bryan Stevenson of the Equal Justice Initiative, took on McMillan's case in 1988 and wrote the 2014 book entitled Just Mercy: A Story of Justice and Redemption on which the movie starring Michael B. Jordan is based.
